Safirst ONE — Construction Safety Operating System

Terms of Service

Effective Date: June 2026 · Last updated: August 31, 2026

These Terms of Service ("Terms") constitute a legally binding agreement between you and Safirst Corporation ("Safirst Corporation," "Company," "we," "our," or "us") governing your use of our website, applications, billing workflows, support channels, and related services (collectively, "Services").

1. Agreement to Terms

By creating an account and downloading, installing, or using the Safirst ONE mobile application ("Application") or web dashboard ("Platform"), or otherwise using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Related Policies

These Terms incorporate our Privacy Policy by reference.

If there is a conflict between these Terms and another Safirst Corporation policy, these Terms control unless the other policy states that it overrides these Terms for that subject.

3. Definitions

"Account Owner" means the person or organization that creates, owns, pays for, or controls a Safirst Corporation organization or workspace.

"Authorized User" means a user invited to or permitted to access an organization or workspace, including owners, administrators, or team members.

"Customer Data" means content, files, records, and other data submitted to, uploaded to, generated in, or processed through the Services by or for you, your organization, or Authorized Users.

"AI-Assisted Functionality" means artificial intelligence, machine-learning, automated-analysis, or generative-AI technologies that Safirst Corporation may use in connection with the Services, including internal tools and functionality that may be made available to users from time to time.

"AI Input" means Customer Data, records, document context, prompts, instructions, or other information processed using AI-Assisted Functionality.

"AI Output" means text, summaries, suggestions, analyses, reports, explanations, or other content generated or assisted by AI-Assisted Functionality.

"Subscription" means a paid or trial plan, add-on, seat, entitlement, usage limit, or other paid access package offered through the Services.

"User" means anyone who accesses or uses the Services.

4. Eligibility

You must be at least 18 years of age and legally able to enter into a binding contract to use the Services. By using the Services you represent and warrant that you are 18 or older. Safirst Corporation reserves the right to terminate any account found to belong to a user under 18.

5. Account Registration

To use most features of the Platform you must create an account. You agree to be responsible for:

  • Providing accurate, complete, and current account, billing, organization, and contact information during registration and to keep that information updated
  • Maintaining the confidentiality and security of your credentials, sessions, devices, and account access
  • Ensuring your Authorized Users comply with these Terms
  • All activity under your account, organization, invitations, secure links, and Authorized Users
  • Notifying us immediately of any unauthorized use of your account at privacy@safirst.one

Safirst Corporation reserves the right to restrict, suspend, or terminate accounts that contain inaccurate information or that violate these Terms or creates legal, security, abuse, or operational risk.

6. Services

Safirst Corporation provides a construction safety operating system, including a mobile application and web dashboard, that helps you manage safety training, inspections, compliance documentation, and related construction safety compliance services.

Safirst Corporation may modify or discontinue features in its discretion. If a material reduction in core paid functionality occurs during a prepaid subscription term, Safirst Corporation may provide a commercially reasonable substitute, a prorated credit, or another appropriate remedy, in its discretion. We will make reasonable efforts to provide notice when a material change substantially affects paid access.

Some features may be subject to plan entitlements, usage limits, storage limits, seat limits, trial restrictions, anti-abuse limits, or other eligibility requirements.

From time to time, Safirst Corporation may offer features, functionality, integrations, or services identified as "beta," "preview," "early access," "experimental," or by a similar designation (collectively, "Beta Features"). Beta Features are made available for evaluation and feedback purposes and may contain errors, defects, or other limitations. Beta Features may be modified, suspended, or discontinued at any time, with or without notice, and Safirst Corporation has no obligation to continue making any Beta Feature generally available.

Unless expressly stated otherwise, Beta Features are provided "AS IS" and "AS AVAILABLE," without any warranties or service level commitments, and are excluded from any uptime, support, maintenance, or performance obligations that may otherwise apply to the Services. To the maximum extent permitted by law, Safirst Corporation shall have no liability arising out of or relating to your use of any Beta Feature.

7. Organization Administration and Authorized Users

Account Owners and administrators control their organization settings, users, roles, permissions, billing profiles, secure document settings, and other organization-management functions made available through the Services. You are responsible for assigning appropriate permissions and for all actions taken by Authorized Users under your organization, including sending documents, entering time, uploading files, changing billing settings, exporting data, inviting users, or deleting accounts or organizations.

If you are an Authorized User, your access may be managed, restricted, or removed by the Account Owner or administrators of the organization.

8. Customer Data

As between you and Safirst Corporation, you retain ownership of Customer Data. You grant Safirst Corporation and its service providers a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, display, reproduce, format, back up, secure, analyze, and otherwise use Customer Data as needed to:

  • Maintain, secure, and improve the Services
  • Provide access to Authorized Users as configured by you or your organization
  • Enforce these Terms, prevent abuse, investigate security issues, and comply with law

You represent and warrant that you have all rights, permissions, consents, and notices necessary to submit Customer Data to the Services and to authorize Safirst Corporation to process it as described in these Terms and our Privacy Policy.

We may create aggregated or de-identified information from Customer Data and usage data for analytics, security, reporting, and product improvement, provided it does not identify you, your organization, or any individual.

9. Data Export, Deletion, and Backups

Authorized Users may be able to export certain organization data through the Services or upon request. To the extent export functionality is available, you are responsible for exporting Customer Data you wish to retain before canceling, deleting, or losing access to an account or organization.

Account deletion, organization deletion, export availability, and retention are further described in our Privacy Policy. Deletion of an account or organization does not necessarily result in deletion of all associated Customer Data. Certain safety, training, inspection, certification, compliance, audit, security, transaction, and legal records may be retained after account or organization deletion, including on a long-term or indefinite basis, as described in the Privacy Policy.

We are not responsible for Customer Data that is lost because of your deletion actions, permission changes, account closure, expired exports, failure to maintain a subscription, or failure to download available exports.

10. Privacy and Data Processing

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. By using the Services, you agree that Safirst Corporation may process personal information as described in the Privacy Policy.

If you submit personal information about others, you are responsible for providing any required notices and obtaining any required rights, consents, or other legal bases.

11. Platform Access and Permitted Use

11.1 License Grant

Subject to these Terms, Safirst Corporation grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your internal business purposes related to construction safety compliance.

11.2 Permitted Uses

  • Complete workplace safety training courses and earn certificates
  • Conduct, submit, and review safety inspections
  • Store and access safety compliance documents
  • Manage worker training records and credentials

11.3 Prohibited Uses

You agree not to:

  • Violate any law, regulation, third-party right, contract, privacy obligation, tax obligation, or professional obligation
  • Attempt to bypass, disable, circumvent, or evade any security feature including the video watch percentage gate or quiz enforcement or attempt any other unauthorized access to systems, accounts, data, secure links, tokens, APIs, or networks
  • Submit false, fraudulent, or misleading information including fabricated inspection findings or credentials
  • Share your account credentials with others or allow unauthorized access to your account
  • Interfere with, disrupt, overload, scrape, probe, scan, reverse engineer, decompile, copy, resell, lease, or misuse the Services or attempt to extract source code from the Platform
  • Use automated tools, bots, or scripts to interact with the Platform
  • Attempt to access any other user's data or any data you are not authorized to access
  • Upload or transmit malware, harmful code, unlawful content, infringing content, or content that is threatening, harassing, defamatory, obscene, discriminatory, or otherwise harmful
  • Misuse AI Features, including to generate harmful content, evade safety or security controls, infer system prompts, mislead recipients, or make unsupported legal, safety, or compliance claims
  • Use the Services to build or benchmark a competing product except where applicable law prohibits this restriction
  • Misrepresent your identity, affiliation, authority, payment status, or entitlement to use data

We may investigate suspected violations and may suspend, restrict, remove, or report content or accounts where we reasonably believe misuse has occurred.

12. Training Courses and Certificates

12.1 Course Access

Access to LMS training courses is granted based on your organization's subscription tier or individual purchase. Complimentary access may be revoked if your organization's consulting relationship with Safirst Corporation ends.

12.2 Certificate Validity

Certificates issued by Safirst ONE are valid for 12 months from the date of completion. Certificates are generated only upon genuine completion of all required training including video watch requirements and quiz passage at the required threshold. Attempting to circumvent these requirements is a material breach of these Terms and may result in certificate revocation and account termination.

12.3 No Refund Policy

All course purchases are final. No refunds are issued once a course has been accessed. If you have a billing dispute contact privacy@safirst.one and we will work with you in good faith.

12.4 Accuracy of Content

Training content is prepared by credentialed safety professionals and references applicable OSHA and ADOSH regulations. However, regulations change and content may not always reflect the most current regulatory requirements. Safirst ONE training is not a substitute for legal advice or official OSHA guidance. Always verify compliance requirements with current OSHA standards and consult qualified professionals for specific compliance questions.

13. Inspection Reports and Safety Documents

13.1 Track A Inspections

Track A inspection reports carry the authority of Safirst Corporation and are produced by or under the supervision of credentialed Safirst Corporation safety professionals. These reports are intended for use in regulatory compliance and ADOSH defense proceedings.

13.2 Track B Inspections

Track B inspections are internal records created by your organization's personnel. They do not carry Safirst Corporation authority or verification and are not represented as Safirst-endorsed compliance documents.

13.3 Your Responsibility

You are responsible for the accuracy and completeness of information you enter while using our Services including but not limited to inspection findings, credential information, and uploaded documents. Safirst Corporation is not liable for any consequences, including but not limited to regulatory consequences, arising from inaccurate or incomplete information you provide.

13.4 Immutability

Certain inspection reports and other records become immutable once submitted, finalized, or filed in the Safety Docs Locker, as indicated through the Services. Records designated as immutable cannot be edited or deleted by users. Any correction to an immutable record must be made through a supplemental or subsequent record rather than by altering the original record.

14. Security; Export Controls and Sanctions Compliance

We use reasonable administrative, technical, and organizational safeguards designed to protect the Services. No service is perfectly secure or uninterrupted.

You are responsible for using appropriate safeguards in your own business, including limiting user permissions, reviewing secure-link recipients, protecting exports, verifying contact information, using secure devices and networks, and keeping credentials confidential.

You represent and warrant that you are not located in, organized under the laws of, or ordinarily reside in any country or territory that is subject to comprehensive U.S. sanctions or embargoes, and that you are not identified on any U.S. government list of prohibited or restricted parties, including those maintained by the U.S. Department of the Treasury's Office of Foreign Assets Control ("OFAC"), the U.S. Department of Commerce, or the U.S. Department of State.

You agree not to access or use the Services in violation of any applicable export control, economic sanctions, or trade laws or regulations of the United States or any other applicable jurisdiction. You will not permit any person or entity to access or use the Services where such access or use would violate applicable export control or sanctions laws.

Safirst Corporation may suspend or terminate access to the Services immediately if it reasonably believes that continued access would violate applicable export control or sanctions laws or would expose Safirst Corporation or its service providers to legal or regulatory risk.

15. Subscriptions, Fees, Taxes, and Billing

Some features require a paid Subscription. By starting a paid Subscription, trial, add-on, or seat purchase, you authorize Safirst Corporation and its applicable payment processors to charge applicable fees, taxes, and recurring amounts according to the pricing, checkout, Billing Policy, and billing settings presented to you.

Unless stated otherwise:

  • Subscription fees are billed in advance
  • Renewals occur automatically until canceled
  • Prices are in U.S. dollars
  • Taxes may be added where applicable
  • You are responsible for all taxes, duties, and similar government assessments related to your use of the Services, other than taxes based on our income
  • Plan changes, add-ons, seats, trials, cancellations, and refunds are governed by the Billing Policy and checkout terms

We may correct pricing, typographical, or billing errors. We may change prices or plan packaging with reasonable notice where required. If you dispute a charge, contact us promptly at privacy@safirst.one.

16. Third-Party Services

The Services rely on or may link to third-party services, including authentication, payment, hosting, artificial intelligence, database, file storage, email, support, analytics, security, and other operational providers. Your use of third-party services may be subject to their own terms and policies.

Safirst Corporation is not responsible for third-party services, content, outages, processing, security incidents, or changes outside our control. We may change providers or integrations as needed to operate the Services.

17. No Professional Advice

Except for professional services expressly provided by Safirst Corporation or its credentialed safety professionals, including applicable Track A inspection services, the Services are software tools and informational resources and do not constitute legal, tax, accounting, financial, or other professional advice.

Training content, software features, automated or AI-assisted content, compliance information, and other materials made available through the Services are intended to support workplace safety and compliance efforts and are not a substitute for applicable legal requirements, official regulatory guidance, or advice from an appropriately qualified professional.

You are responsible for determining whether your business operations and workflows satisfy the laws, regulations, professional obligations, and agreements applicable to you.

18. Intellectual Property

The Services, software, website, designs, text, graphics, logos, trademarks, trade names, features, interfaces, workflows, and other content provided by Safirst Corporation are owned by Safirst Corporation or our licensors and are protected by intellectual property laws.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your internal business purposes.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from the Services except as expressly allowed by these Terms or applicable law.

19. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFIRST CORPORATION DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AVAILABILITY, ACCURACY, RELIABILITY, SECURITY, ERROR-FREE, UNINTERRUPTED OPERATION, OR NON-INFRINGEMENT. SAFIRST CORPORATION DOES NOT WARRANT THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS, PREVENT ALL DATA LOSS, SATISFY YOUR LEGAL OR PROFESSIONAL OBLIGATIONS, BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR PRODUCE OUTCOMES THAT ARE CORRECT FOR YOUR BUSINESS. SAFIRST CORPORATION DOES NOT WARRANT THAT USE OF THE PLATFORM WILL ENSURE REGULATORY COMPLIANCE OR PREVENT OSHA OR ADOSH CITATIONS. THE PLATFORM IS A TOOL TO SUPPORT YOUR COMPLIANCE EFFORTS — IT IS NOT A GUARANTEE OF COMPLIANCE.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAFIRST CORPORATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS OPPORTUNITY, BUSINESS INTERRUPTION, OR REGULATORY FINES AND PENALTIES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFIRST CORPORATION'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO SAFIRST CORPORATION IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT PERMIT CERTAIN LIMITATIONS OF LIABILITY. ACCORDINGLY, SOME LIMITATIONS MAY NOT APPLY.

21. Indemnification

You agree to indemnify, defend, and hold harmless Safirst Corporation and its affiliates, officers, directors, contractors, service providers, employees, and agents from and against any claims, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your Customer Data; (e) your AI input, AI output, or use of AI features; (f) your Authorized Users' use of the Services; or (g) your infringement or alleged infringement of third-party rights.

22. Communications and Electronic Notices

You agree that we may send notices and communications electronically, including by email, in-app messages, account notices, billing portal notices, or posting to the Services. Electronic notices satisfy any legal requirement that notices be in writing unless applicable law requires otherwise.

You are responsible for keeping your contact and billing information current. Important account, billing, legal, security, and transactional notices may still be sent even if you opt out of optional communications.

23. Feedback

If you provide ideas, requests, comments, bug reports, or suggestions, you grant Safirst Corporation a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation to you.

24. Suspension and Termination

Safirst Corporation may suspend, restrict, or terminate your access to the Services at any time for any reason if:

  • You violate these Terms
  • You fail to pay fees or if payment fails
  • Your use creates security, abuse, legal, operational, or reputational risk
  • We are required to do so by law, court order, payment processor requirement, or third-party provider requirement
  • Your account or organization is inactive, closed, deleted, or no longer eligible for access

You may terminate your account at any time by contacting privacy@safirst.one. Upon termination your license to use the Services ends immediately. Termination does not relieve you of payment obligations incurred before termination. Sections that by their nature should survive termination will survive, including Customer Data licenses needed for retention and compliance, payment obligations, intellectual property, disclaimers, limitation of liability, indemnification, governing law, and miscellaneous terms. Data retained after termination is subject to our Privacy Policy and may be retained for applicable legal, safety, compliance, security, recordkeeping, and other legitimate business purposes as described in the Privacy Policy.

25. International Use

The Services are currently intended for use within the United States. If you access the Services from outside the United States, you do so on your own initiative and are responsible for compliance with applicable local laws. Safirst Corporation makes no representation that the Services are appropriate or available for use in other locations, and reserves the right to expand its compliance practices as it grows into new markets.

26. Dispute Resolution; Binding Arbitration

Except for claims that qualify for resolution in small claims court, claims seeking temporary or preliminary injunctive relief relating to intellectual property or unauthorized access to the Services, or any other claims that applicable law prohibits from being arbitrated, any dispute, claim, or controversy arising out of or relating to these Terms or the Services, including their formation, interpretation, breach, termination, enforcement, or validity (each, a "Dispute"), shall be resolved exclusively by final and binding arbitration.

The arbitration shall be administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules then in effect. The arbitration shall be conducted by a single arbitrator. Unless otherwise required by applicable law or agreed by the parties, the arbitration shall take place in Maricopa County, Arizona, or may be conducted remotely by video conference at the arbitrator's discretion.

The arbitrator shall have exclusive authority to resolve all issues relating to the interpretation, applicability, enforceability, or formation of this arbitration provision, including any claim that all or part of this provision is void or unenforceable. Judgment upon the arbitration award may be entered in any court having jurisdiction.

Nothing in this Section prevents either party from seeking temporary or preliminary equitable relief from a court of competent jurisdiction to protect confidential information, intellectual property rights, or the security or integrity of the Services pending completion of arbitration.

27. Class Action Waiver; Jury Trial Waiver

To the fullest extent permitted by law, all Disputes shall be brought solely in an individual capacity and not as a plaintiff or class member in any purported class action, collective action, consolidated action, representative action, mass action, or private attorney general action.

The arbitrator shall have no authority to consolidate claims of multiple parties or to preside over any class, collective, representative, or consolidated proceeding.

If this class action waiver is found to be unenforceable as to any claim, then that claim shall proceed in a court of competent jurisdiction and not in arbitration, while the remaining provisions of these Terms shall remain in full force and effect.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EACH PARTY KNOWINGLY, VOLUNTARILY, AND IRREVOCABLY WAIVES ANY RIGHT TO A JURY TRIAL FOR ANY DISPUTE THAT IS PERMITTED TO PROCEED IN COURT.

28. Miscellaneous

These Terms, together with the policies incorporated by reference, are the entire agreement between you and Safirst Corporation regarding the Services.

If any provision is found unenforceable, the remaining provisions will remain in effect. You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, operation of law, or similar transaction.

Our failure to enforce a provision is not a waiver. Headings are for convenience only.

29. Force Majeure

Safirst Corporation will not be liable for any delay, interruption, failure, or degradation in the performance or availability of the Services to the extent caused by circumstances beyond its reasonable control, including acts of God, natural disasters, fire, flood, earthquake, severe weather, epidemic or pandemic, war, terrorism, civil unrest, labor disputes, governmental actions, embargoes, sanctions, power outages, internet or telecommunications failures, denial-of-service attacks, cyberattacks, failures or interruptions of cloud hosting providers, payment processors, domain name services, AI model providers, or other third-party service providers, or any other event beyond Safirst Corporation's reasonable control (each, a "Force Majeure Event").

During a Force Majeure Event, Safirst Corporation's obligations affected by the Force Majeure Event shall be suspended for the duration of the event. Safirst Corporation will use commercially reasonable efforts to mitigate the effects of the Force Majeure Event and resume performance as soon as reasonably practicable. Nothing in this Section relieves Customer of its obligation to pay fees accrued before the Force Majeure Event or for Services made available during the applicable billing period, except as otherwise expressly provided in these Terms or required by applicable law.

30. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Arizona without regard to conflict of law principles. To the extent any Dispute is not subject to arbitration under Section 26, the parties agree that the exclusive venue shall be the state or federal courts located in Maricopa County, Arizona, or, if no federal court has jurisdiction there, the nearest federal court having jurisdiction. Each party irrevocably submits to the personal jurisdiction of those courts.

You agree to contact Safirst Corporation at privacy@safirst.one and attempt to resolve the dispute informally for at least 30 days prior to initiating any legal proceeding.

31. Changes to Terms

Safirst Corporation may update these Terms from time to time. The updated version is effective when posted at this page with a revised Effective Date, unless a later effective date is stated. Your continued use of the Services after updates constitutes acceptance of the updated Terms.
