Terms of Service
Effective Date: June 2026
This document is written in plain language for clarity. It is a legally binding agreement between you and Safirst Corporation. Please read it carefully before using the Safirst ONE platform. If you have questions contact us at privacy@safirst.one.
1. Agreement to Terms
By downloading, installing, or using the Safirst ONE mobile application or web dashboard ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
These Terms constitute a legally binding agreement between you and Safirst Corporation. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility
You must be at least 18 years of age to use Safirst ONE. By using the Platform you represent and warrant that you are 18 or older. Safirst Corporation reserves the right to terminate any account found to belong to a user under 18.
3. Account Registration
To use most features of the Platform you must create an account. You agree to:
- Provide accurate, complete, and current information during registration
- Maintain and promptly update your account information
- Keep your password secure and not share it with others
- Notify us immediately of any unauthorized use of your account at privacy@safirst.one
- Accept responsibility for all activities that occur under your account
Safirst Corporation reserves the right to suspend or terminate accounts that contain inaccurate information or that violate these Terms.
4. Platform Access and Permitted Use
4.1 License Grant
Subject to these Terms, Safirst Corporation grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your internal business purposes related to construction safety compliance.
4.2 Permitted Uses
- Complete OSHA-compliant safety training courses and earn certificates
- Conduct, submit, and review safety inspections
- Store and access safety compliance documents
- Manage worker training records and credentials
- Use the Safety AI Assistant for compliance guidance
4.3 Prohibited Uses
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable regulation
- Attempt to bypass, disable, or circumvent any security feature including the video watch percentage gate or quiz enforcement
- Submit false, fraudulent, or misleading information including fabricated inspection findings or credentials
- Share your account credentials with others or allow unauthorized access to your account
- Reverse engineer, decompile, or attempt to extract source code from the Platform
- Use automated tools, bots, or scripts to interact with the Platform
- Interfere with or disrupt the integrity or performance of the Platform
- Attempt to access any other user’s data or any data you are not authorized to access
- Use the Platform to store or transmit malicious code
5. Training Courses and Certificates
5.1 Course Access
Access to LMS training courses is granted based on your organization's subscription tier or individual purchase. Complimentary access may be revoked if your organization's consulting relationship with Safirst Corporation ends.
5.2 Certificate Validity
Certificates issued by Safirst ONE are valid for 12 months from the date of completion. Certificates are generated only upon genuine completion of all required training including video watch requirements and quiz passage at the required threshold. Attempting to circumvent these requirements is a material breach of these Terms and may result in certificate revocation and account termination.
5.3 No Refund Policy
All course purchases are final. No refunds are issued once a course has been accessed. If you have a billing dispute contact privacy@safirst.one and we will work with you in good faith.
5.4 Accuracy of Content
Training content is prepared by credentialed safety professionals and references applicable OSHA and ADOSH regulations. However, regulations change and content may not always reflect the most current regulatory requirements. Safirst ONE training is not a substitute for legal advice or official OSHA guidance. Always verify compliance requirements with current OSHA standards and consult qualified professionals for specific compliance questions.
6. Inspection Reports and Safety Documents
6.1 Track A Inspections
Track A inspection reports carry the authority of Safirst Corporation and are produced by or under the supervision of credentialed Safirst Corporation safety professionals. These reports are intended for use in regulatory compliance and ADOSH defense proceedings.
6.2 Track B Inspections
Track B inspections are internal records created by your organization's personnel. They do not carry Safirst Corporation authority or verification and are not represented as Safirst-endorsed compliance documents.
6.3 Your Responsibility
You are responsible for the accuracy and completeness of information you enter into the Platform including inspection findings, credential information, and uploaded documents. Safirst Corporation is not liable for regulatory consequences arising from inaccurate or incomplete information you provide.
6.4 Immutability
Once an inspection report or document migrates to the Safety Docs Locker it becomes an immutable record. This is by design for regulatory compliance. Corrections to migrated records must be submitted as new supplemental documents.
7. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranty of any kind. Safirst Corporation disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Safirst Corporation does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. Safirst Corporation does not warrant that use of the Platform will ensure regulatory compliance or prevent OSHA or ADOSH citations. The Platform is a tool to support your compliance efforts — it is not a guarantee of compliance.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Safirst Corporation shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including lost profits, lost data, or regulatory fines and penalties. Safirst Corporation's total liability to you for any claim arising out of or related to these Terms or the Platform shall not exceed the amount you paid to Safirst Corporation in the twelve months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless Safirst Corporation and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any inaccurate information you submit through the Platform.
10. Termination
Safirst Corporation may suspend or terminate your access to the Platform at any time for any reason including violation of these Terms. You may terminate your account at any time by contacting privacy@safirst.one. Upon termination your license to use the Platform ends immediately. Data retained after termination is subject to our Privacy Policy and applicable legal retention requirements.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Arizona without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona. You consent to personal jurisdiction in those courts. Before initiating any legal proceeding, you agree to contact Safirst Corporation at privacy@safirst.one and attempt to resolve the dispute informally for at least 30 days.
12. Changes to Terms
Safirst Corporation may update these Terms from time to time. We will notify you of material changes by posting a notice in the app and updating the Effective Date. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.
